By downloading, installing, or using Papaya Peg, these terms apply to you. This app is provided by Matthew Fadoul for your personal, non-commercial entertainment use. If you do not agree to these terms, do not use the application.
I grant you a non-transferable, non-exclusive license to use Papaya Peg on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions and the App Store Terms of Service. The app is licensed, not sold.
You may not distribute, sublicense, copy, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Papaya Peg, except as permitted by applicable law, by Apple's applicable terms, or by the licensing terms for any open-source components included with the app.
All trademarks, copyright, and other intellectual property rights related to Papaya Peg belong to Matthew Fadoul or their respective owners. You may not attempt to extract the source code, modify the app, or redistribute its assets except as allowed by these terms or applicable law.
Matthew Fadoul is solely responsible for providing any maintenance and support services for this application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Papaya Peg. Support requests may be sent to the contact email below.
Papaya Peg is provided "AS IS" and "AS AVAILABLE." I make no guarantees that the app will be error-free or that it will function without interruption. To the maximum extent permitted by applicable law, I disclaim all warranties and conditions, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the maximum extent permitted by applicable law, I am not liable for any personal injury, direct, indirect, incidental, special, consequential, or other loss resulting from your use of, inability to use, or reliance on Papaya Peg or its services, including loss of data, gameplay progress, virtual items, or other app content. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
Papaya Peg may display banner advertisements and optional rewarded video advertisements using Google AdMob and may use Google's User Messaging Platform to request and manage advertising consent or privacy choices where required. Rewarded ads are shown only when you choose to watch one in exchange for an in-app reward, such as Papayas that can be spent on Hint or Undo credits. Your use of the app is also subject to Google's applicable advertising and privacy practices.
Papaya Peg may offer optional Apple Game Center features, including leaderboards and achievements. If you choose to enable these features, you authorize Papaya Peg to submit the gameplay information needed for those features, such as scores and achievement progress, to Apple through Game Center. Your use of Game Center is also subject to Apple's applicable terms, privacy policy, and Game Center settings.
Papaya Peg may offer optional iCloud Sync using Apple's CloudKit framework and your own private iCloud database. If iCloud Sync is available and active, you authorize Papaya Peg to store and merge certain gameplay data, described in the Privacy Policy, in your private iCloud database so it can be shared across your devices. This may include Shared Papayas, local credit balances, completed results, challenge completion results, Quest progress, and in-progress active game snapshots. Your use of iCloud Sync is also subject to Apple's applicable terms, privacy policy, and iCloud account settings.
External services may not be available in all locations or at all times. I am not responsible for third-party services, their content, their availability, or their handling of information. You are responsible for using any external services in a way that complies with applicable laws and the relevant third-party terms.
Papaya Peg offers optional consumable in-app purchases ("Papaya packs") that add Shared Papayas, the app's in-game currency. Papayas can be moved onto a device through iCloud Sync when available and spent inside the app for local Hint and Undo credits. Prices are set and displayed by the App Store in your local currency at the time of purchase and may change without notice.
All purchases are billed and processed by Apple through your Apple ID; I do not process payments directly and have no access to your payment information. Papaya packs, Papayas, Hint credits, and Undo credits are consumable digital items: once granted, they cannot be resold, transferred to another person, exchanged for real currency, or redeemed outside the app, and they do not expire while the app continues to support them.
Purchases are non-refundable except as required by applicable law or Apple's own refund policies. Refund requests are handled by Apple, not me; you can request one through your Apple ID purchase history or at reportaproblem.apple.com. Because Papaya packs are consumable, Apple's standard purchase-restore mechanism does not apply to them. Purchased Papayas already added to your app data may instead appear on your other devices through Shared Papayas in iCloud Sync, described in the Privacy Policy, when iCloud Sync is available and active.
If you have a claim related to Papaya Peg or your possession or use of the app, including product liability, consumer protection, privacy, or intellectual-property claims, contact me using the email address below. Apple is not responsible for addressing claims relating to Papaya Peg or your possession or use of it.
I may update these terms from time to time. Your continued use of the app constitutes acceptance of the updated terms.
This license remains effective until terminated. I may suspend or terminate your rights under this Agreement at any time if you fail to comply with these terms. Upon termination, you must cease all use of Papaya Peg.
You may not use, export, or re-export Papaya Peg except as authorized by United States law and the laws of the jurisdiction in which the app was obtained. You represent that you are not located in a country or on a list where receiving or using the app would be prohibited by applicable United States export laws or sanctions, including any U.S. embargoed country or any U.S. government denied-party or sanctions list.
Papaya Peg and related documentation are commercial items developed at private expense and are provided to U.S. Government end users with only the rights granted to other users under this Agreement.
This Agreement and your use of Papaya Peg are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, except where applicable consumer-protection law requires otherwise. If you are a resident of a jurisdiction that requires disputes to be governed by the laws or courts of your usual place of residence, those mandatory rules may apply.
